PREMISES

These General Conditions of Sale and Use govern the purchase of products made remotely through the website www.ugopoggifirenze.com, owned by Ugo Poggi s.a.s. di Grazia Lombardi Poggi C. located in Florence, Via Strozzi 26R, VAT number 00588690487. Every purchase transaction will be regulated by the provisions of Legislative Decree 185/99, Legislative Decree 206/05; the information aimed at concluding the contract will be subject to Article 12 of Legislative Decree 70/03 and, regarding privacy protection, will be subject to the regulations of Legislative Decree 196/03 (privacy).

The General Conditions of Sale may be modified at any time, subject to the user’s right of withdrawal. Any changes and/or new conditions will be in effect from the moment of their publication on the site. The applicable General Conditions are those in force on the date of sending the purchase order. These conditions do not govern the sale of products and/or the provision of services by subjects other than Ugo Poggi that are present on the site through links, banners, or other hypertext links. Before carrying out commercial transactions with such subjects, it is necessary for the user to verify their conditions of sale. Ugo Poggi is not responsible in any way for the provision of services and/or the sale of products by such subjects, nor for the content present on their sites including any errors and/or omissions and/or violations of law by them.

Ugo Poggi reserves the right to refuse, at its sole discretion, the registration of a user. Ugo Poggi also reserves the right not to accept orders, from anyone, that are in some way anomalous for, by way of example and not limited to, quantity, frequency, methods, etc.

CONCLUSION OF THE CONTRACT AND ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

Before proceeding with the conclusion of a sales contract, it is necessary to register on the Site, entering name, surname, email address and password (hereinafter “registration credentials”). Registration on the site is free. Registration is confirmed by email sent to the address provided by the user. The registration credentials must be used exclusively by the user and cannot be transferred to third parties. The user will hold Ugo Poggi harmless from any compensation obligation, resulting sanction and/or in any way connected to the violation by the user of the rules on registration to the Site. The user is solely responsible for access to the Site through the Registration Credentials and directly responds to any damage or prejudice caused to Ugo Poggi or to third parties by improper use, loss, misappropriation by others or failure to protect the adequate secrecy of their Registration Credentials. All operations carried out through the Registration Credentials are considered carried out by the customer to whom the Credentials themselves refer.

The sales contracts for products on the website www.ugopoggifirenze.it are considered concluded when the purchase order, in electronic format, is transmitted electronically by the customer to Ugo Poggi following the instructions that will appear from time to time on the site and the latter accepts it by sending to the user, at the indicated email address, a confirmation email containing a link to access a summary of the General Conditions, information relating to the characteristics of the purchased product, detailed indication of the price, the payment method used, the methods for exercising the right of withdrawal, shipping costs and any additional costs. In any case, no contract will be considered concluded without the customer having electronically accepted the General Conditions of Sale during the purchase.

The customer, by electronically sending their purchase order, declares to have read and accepted these general contract conditions and undertakes to observe and respect them in their relations with Ugo Poggi.

PROCESSING OF PERSONAL DATA

Ugo Poggi, pursuant to Article 13 of Legislative Decree 196/2003, informs that personal, anagraphic and fiscal data acquired also verbally in reference to established commercial relationships, provided directly by the interested parties, or otherwise acquired within the company’s activity, will be subject to processing in compliance with the referenced legislation and for the aforementioned purposes, including the confidentiality obligations provided for therein. In relation to the aforementioned, the rights referred to in Article 7 of Legislative Decree 196/2003 may be exercised.

CUSTOMER OBLIGATIONS

The Customer is required, before submitting their purchase order, to carefully read these general terms of sale. Submitting the purchase order implies full knowledge and acceptance of these terms.

Finally, the Customer is required, once the online purchase procedure is concluded, to print and keep these general contract conditions, which have already been viewed and accepted during the contract conclusion phase.

PURCHASE METHODS

The offers published on the Site are available for a limited time period and with limited product quantities. The validity date of the offers is indicated on the Site. All prices shown on the Site are in Euro and include VAT. This amount will be shown separately for each product on the order form and in the order confirmation email. The products will remain the property of Ugo Poggi until the purchase price and expenses have been paid by the Customer. Ugo Poggi will process the purchase order only after receiving confirmation of the authorization to pay the total amount due as indicated in the order. The customer purchases the product, whose characteristics are illustrated online in the relevant descriptive and technical sheets, at the price indicated there, plus the delivery costs specified on the site. Before submitting the purchase order, the unit cost of each selected product, the total cost in case of purchase of multiple products, and the related delivery costs are summarized.

Once the purchase order has been submitted, the customer will receive an email message from Ugo Poggi confirming receipt of the purchase order and containing information regarding the main characteristics of the purchased item, detailed indication of the price, delivery costs, applicable taxes and payment methods, and containing a reference to the general contract conditions and information about the existence of the right of withdrawal, the conditions and methods of its exercise displayed on the site.

PAYMENT

The customer can make the payment due by credit card. Ugo Poggi accepts credit cards from VISA, MASTERCARD, JCB, DINERS, AMERICAN EXPRESS circuits.

The customer can use the PayPal payment procedure, which is suitable for ensuring the confidentiality of data provided by customers. On the occasion of the first purchase, the user will be asked to provide the data for the receipt. If an invoice is deemed necessary, the customer is required to communicate this during the purchase process. In case of non-payment, Ugo Poggi will charge the costs related to the management of the unpaid amount to the customer and will refuse the related purchase order, notifying via email.

PRODUCT DELIVERY

The purchased item is delivered by courier to the address specified by the Customer at the time of the online order. The user is solely responsible for the address provided for shipping. Any specific requirements must be presented to Ugo Poggi by the customer. In case of impediments to delivery due to force majeure, Ugo Poggi will contact the customer by email to inform them of the delay in delivery times. Ugo Poggi cannot be held responsible for any delays due to third party events and/or force majeure.

In case of failed delivery due to absence of the recipient at the address indicated in the order, the courier will leave a notice to certify the delivery attempt. The notice will indicate the data that the customer can use to contact the courier to set an appointment for the second delivery attempt, or to find out the address of the nearest UPS branch or set up pickup at a UPS Point. If within three days the recipient has not contacted UPS in any way to define a pickup or delivery method, the package will remain in storage at the courier for 30 days. For this period, the courier will have the right to request from the customer the payment of a daily flat-rate reimbursement of expenses. If this storage period passes without action, the product will be sent back to the sender and the contract will be considered terminated. Ugo Poggi will proceed to refund the amount paid by the customer, minus the delivery costs of the unsuccessful product delivery, storage costs, and other expenses.

LEGAL GUARANTEE OF CONFORMITY AND DEFECTIVE PRODUCTS

The products sold on the Site are covered by the Legal Guarantee of Conformity provided for by articles 128 – 135 of the Consumer Code; this guarantee is reserved for consumers.

The description of the products offered on the Site is that which the suppliers, under their own responsibility, have communicated to Ugo Poggi. The images and colors of the products published on the Site may differ from the actual ones due to local settings of the systems and/or tools used for their display. Ugo Poggi is not responsible for any mismatch between the product published on the site and the one ordered, in cases where the mismatch derives from errors in the description attributable to the supplier and of which Ugo Poggi was not aware and could not have been aware using normal diligence.

Ugo Poggi is responsible to the consumer for any lack of conformity existing at the time of delivery of the product and that manifests itself within two years from such delivery. The defect must be reported to Ugo Poggi, under penalty of forfeiture of the warranty, within two months from the date it was discovered by sending an email to the following address: customercare@ugopoggifirenze.it.

In case of lack of conformity of the products purchased compared to the publication on the Site, the user has the right to repair or replacement of the product, without any additional expense, where this is possible in relation to the number of products still available and unless the replacement or repair is excessively burdensome for the seller in relation to the value of the good, in the absence of lack of conformity. Alternatively, the user has the right to terminate the contract or to a price reduction.

Unless proven otherwise, it is presumed that defects of conformity that manifest within six months of delivery of the product already existed at that date, unless this hypothesis is incompatible with the nature of the product or with the nature of the lack of conformity. To be able to take advantage of the Legal Warranty, the user must therefore provide proof of the date of purchase and delivery of the goods. Products repaired, modified or in any way altered by the user are excluded from the Legal Warranty. Any failures, malfunctions or defects of other types determined by accidental facts or by user responsibility or by use of the product not in accordance with its intended use and/or as provided in the technical documentation attached to the product, where existing, or in the instructions for use relating to it, are also excluded from the scope of the Legal Warranty. The conventional warranties relating to the products sold are those provided by the manufacturer.

The products purchased on the site are subject to the regulations on the sale of consumer goods.

RIGHT OF WITHDRAWAL

On Ugo Poggi, the consumer has the right to withdraw from the contract, without giving reasons, within 14 days from the day on which he or a third party, other than the carrier and designated by him, acquires physical possession of the last good pursuant to art. 5 of Legislative Decree no. 185 of May 22, 1999.

To exercise the right of withdrawal, the customer is required to inform the seller at Ugo Poggi, Via Strozzi 26 R 50123 Florence, email customercare@ugopoggifirenze.it, of the decision to withdraw from this contract by means of an explicit declaration (for example, letter sent by post, fax or email). For this purpose, it is possible to use the standard withdrawal form that can be downloaded from our website on the Returns page.

If the customer withdraws from the purchase contract, all payments made in our favor will be reimbursed, including delivery costs (with the exception of additional costs resulting from your possible choice of a type of delivery different from the least expensive type of standard delivery offered by us), without undue delay and in any case no later than 14 days from the day we are informed of your decision to withdraw. These refunds will be made using the same means of payment used for the initial transaction, unless you have expressly agreed otherwise. Only the shipping costs of the goods to the warehouse will be borne by the customer.

The refund may be suspended until receipt of the goods. The consumer is only responsible for the diminution in value of the goods resulting from handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods. The customer must ship the product adequately packaged in its original packaging to Ugo Poggi Via dei Giacomini 1R 50123 Florence.

Ugo Poggi does not accept returns of damaged items, but accepts items kept in normal condition, maintained with due diligence. Products damaged by detergents/additives, or products damaged by the customer due to inexperience will not be replaced or refunded. The customer must include a copy of the delivery document received inside the packaging box. The risks of transport for the return of products are entirely borne by the customer.

In case of exercising the right of withdrawal for only part of the order, only the price of the returned products will be refunded. In case of partial withdrawal of the order, the customer who benefited from free shipping during the initial order for having exceeded a minimum order value may be charged the shipping costs corresponding to the order made if the latter is of lower value than the minimum purchase required to obtain free shipping.

EXPRESS TERMINATION CLAUSE

In case of total or partial non-payment of the purchase price of the goods, Ugo Poggi reserves the right to declare, pursuant to and for the effects of art. 1456 of the Italian Civil Code, this contract terminated by sending a written communication to the customer’s email address.

COMPLAINTS

For any complaint or clarification, the customer must write to the email address customercare@ugopoggifirenze.it. The customer will be contacted for clarifications within 3 working days from the request.

APPLICABLE LAW AND JURISDICTION

This contract is governed by Italian law. The jurisdiction and exclusive forum for any legal action brought by the Buyer under this warranty or any additional legal warranties will be the Court of Florence. In the event of Ugo Poggi’s victory in any legal action, the plaintiff must reimburse Ugo Poggi for the expenses, including attorneys’ fees and court costs, incurred by Ugo Poggi for its defense.

REFERENCE

For anything not expressly provided for in this contract, the current Italian law provisions apply.

WEBSITE CONTENTS AND INTELLECTUAL PROPERTY RIGHTS

The contents of Ugo Poggi, such as, by way of example, works, images, photographs, dialogues, music, sounds, videos, documents, drawings, figures, logos and any other material, in any format, published on the Site, including menus, web pages, graphics, colors, schemes, tools, characters and web designs, diagrams, layouts, methods, processes, functions and software, are protected by copyright and any other intellectual property right of Ugo Poggi and other rights holders. The production, modification, duplication, copying, distribution, sale, or otherwise exploitation of the images, contents of the Site is prohibited unless previously authorized by Ugo Poggi. Any use of the Site’s contents for commercial and/or advertising purposes is also prohibited.

All other distinctive products that distinguish the products sold on the Site are registered trademarks of their respective owners and are used by Ugo Poggi under license, for the sole purpose of distinguishing, describing or advertising the products present on the Site. Any use of the aforementioned distinctive signs that is not in compliance with the law and, as unauthorized, is prohibited. It is in no way permitted to use any distinctive sign present on the Site to take advantage of their distinctive character or reputation or in a way that harms them and their owners.

Under no circumstances may the user alter, change, modify or adapt the Site, nor the material made available by Ugo Poggi.

SHIPPING

Delivery Countries

We deliver to the following countries:

Shipping is carried out by fast and reliable couriers, selected based on the volume of products and the geographical area of destination, including UPS, BRT, LUNIC.
Shipping costs

Shipping is free in Italy for orders over €500. For foreign shipments, it’s free for orders over €1500. Shipping is not free for the purchase of a bulky product. Generally, shipping costs vary based on the volumetric weight of the purchased product, i.e., the weight and dimensions of the properly packaged product. If you wish, you can request delivery to your floor for an additional cost.

Delivery Times

We promptly deliver all products purchased through fast and efficient couriers.
You can find the expected delivery time on the website www.ugopoggifirenze.it on the description page of each product and in your order confirmation.
Please note that delivery times are for indicative purposes only and, although usually respected, we cannot guarantee compliance.
For deliveries to Calabria, Sicily, Sardinia, smaller islands, and difficult-to-reach areas, an additional day is expected for delivery compared to the indicative time shown on the website.

Delivery Methods

The courier usually delivers from 9:00 AM to 6:00 PM, Monday to Friday, to the street level without prior notice, with the exception of shipping bulky products.
In case of the recipient’s absence, the courier leaves a notice to certify the delivery attempt. On the notice, you will find the courier’s contact details to schedule an appointment for the second delivery attempt, or to find the address of the nearest branch.
If you do not contact the courier within three days of the first delivery attempt, the package will remain in storage at the courier for 30 days. If you do not collect it even during the storage period, the product will be sent back to us, and the contract will be considered terminated.
Ugo Poggi will proceed with the refund of the due amount, minus the costs of the unsuccessful product delivery, storage fees, return shipping to the sender, and any other expenses.

Order Status

As soon as the order is activated, we send an email with the purchase confirmation. Excluding bulky products, at the time of shipment, you will receive from us or directly from the courier a communication with the shipping number that can be used to check the delivery status of your package. You can check where your package is from the indicated courier’s website.

Upon delivery, check that the packaging is intact:
if you notice any damage, you can contest it by adding a written motivated reservation (e.g., “Punctured packaging”, “Crushed packaging”). Only by following this procedure will you be able to activate the refund process.

Delivery Address

The delivery address used is the one specified at the time of order confirmation. Please verify that it is correct in every part to avoid issues at the time of delivery. We remind you that it is important to provide your phone number so that we can contact you at any time in case of delivery problems. If you think you won’t be at home during delivery hours, you can indicate your work address instead of your home address or that of a neighbor who you are sure will be at home.

Lost Package

RETURNS

Return Information for packages with Ugo Poggi

On Ugo Poggi, returns are easy, and you have the right to withdraw from the contract, without giving reasons and without paying penalties, within 14 days from the day you or a third party, other than the carrier and designated by you, acquires physical possession of the last item from the product delivery. Only the shipping costs of the goods will be at your expense.

To exercise the right of withdrawal, you are required to inform us at Ugo Poggi s.a.s. Inside the packaging, you must include a copy of the order confirmation, received by email when the order was placed, useful for tracking the return at its destination.

You can also pay through PayPal in complete security thanks to SSL (Secure Sockets Layer) technology which ensures that no one can in any way read the information sent over the internet. Ugo Poggi does not process or store card data.
